Terms and Conditions
Article – Definities
In these general terms and conditions the following terms shall have the following meanings:
YD Visuals: established in Flevoland.
Client: the natural or legal person who enters into an agreement with YD Visuals.
Agreement: any arrangement between YD Visuals and the client relating to services.
Article 2 – Applicability
These terms and conditions apply to all quotations, agreements and services of YD Visuals.
Deviations are only valid if agreed in writing.
Article 3 – Services
YD Visuals offers, among other things:
Photography
Promotional videos
Drone footage
Website design and construction
YD Visuals carries out the work to the best of its knowledge and ability
Article 4 – Quotations and agreements
Quotations are without obligation and valid for 30 days
An agreement is concluded after written confirmation or approval by e-mail.
Article 5 – Execution and planning
The client shall provide all necessary information in a timely manner
Delivery times are indicative and not strict deadline
In the event of force majeure (weather, technical failures, illness) a recording can be rescheduled.
Article 6 – Payment
Invoices must be paid within 14 days.
YD Visuals may require a 30-50% down payment.
In case of late payment, statutory interest and collection costs may be charged.
Article 7 – Copyright and use
All images and designs created remain the property of YD Visuals, unless otherwise agreed.
The client receives the right of use.
YD Visuals may use the work for portfolio and promotion, unless otherwise agreed in writing.
Article 8 – Liability
YD Visuals is not liable for indirect or consequential damages.
Liability is limited to the invoice amount of the relevant assignment
Article 9 – Cancellation
In case of cancellation within 48 hours before scheduled shooting, 50% of the agreed amount can be charged.
In case of cancellation on the day itself, 100% can be invoiced.
Article 10 – Applicable law
Dutch law applies to all agreements.
